The below mentioned General Terms and Conditions become valid and acknowledged by booking. Casas y Fincas (CYF) arranges for rentals on behalf of and by power of attorney of the corresponding proprietor or administrator of the estates to be let. Other services, apart from those mentioned in the lease, do not have to be provided by Casas y Fincas.
1. Booking
Booking must be made in writing (e-mail or phone) by the tenant. CYF will confirm the booking by e-mail or telefax, and thereby the booking is binding. The booking is carried out on behalf of the proprietor, landlord, administrator of the estate to be let. The booking refers to the mentioned period of time and for the booked number of guests.
2. Payment
When concluding contract, a down payment in the amount of 15% of the total rental cost is due. This amount is to be transferred to CYF within one week. If not done so, the booking is cancelled and the tenant does not have any right to use the property to be let. The remaining amount of the sum agreed upon is to be paid after having deducted the already made down payment, in cash, if not agreed otherwise, on the first day of the rental period.
3. Deposit
Deposit is always to be left in cash. It ensures that the client complies with his obligations. The amount of deposit can be taken from the description of the property to be let.
4. Day of arrival and departure
On the day of arrival guests can move in the property starting from 16:00 h (4:00 pm). On the day of departure, the property must be left by 10:00 am a the latest. Arrangements differing from these rules can be made with CYF.
5. Service
All services provided by CYF are services arranged for by third parties between tenant and landlord / proprietor/ administrator. The contract is concluded on behalf of and for the account of the corresponding proprietor/ landlord / administrator. All claims for damages by the tenant have to be presented to the corresponding proprietor.
6.Responsibility
Description of the properties to be let have been prepared to the best of our knowledge and according to information provided by the proprietor. CYF does not accept any responsibility for possible discrepancy. There is no responsibility for any influence on the property by force majeure such as: strike, war, earthquake, power or water cut common in the corresponding country or bad weather. In case use of the property is not possible due to force majeure and no replacement can be arranged for, responsibility is limited to the amount of the already made payment. The use of the property to be let, including all pertinent exterior facilities and equipment is made solely at the tenant´s risk. The proprietor and CYF do not accept any responsibility in case of accidents. The tenant is the only responsible for his belongings and valuables brought into the property. The proprietor and CYF will not accept any responsibility in case of theft.
7. Damages
The tenant is personally liable for damages caused by himself, by one of the other guest accompanying him or any visitors. The tenant is obliged to report all damages occurred during his stay to the proprietor or CYF. The tenant is asked to check the inventory of the property on arrival
and report any defects within 24 hours to the proprietor or CYF.
8. Withdrawal
Withdrawal of the contract must be made in writing by the tenant ( e-mail or telefax ). Relevant is the date of receipt at CYF. The following rescission fees of the total amount of lease are due:
- Up to 90 days before beginning of lease: 30%
- Up to 30 days before beginning of lease: 60%
- 29 days or less before beginning of lease: 100%
After agreement has been reached, a replacement client can be offered at the same conditions. Fee for modification of booking or cancellation is 40 euros.
9. Right of withdrawal
Casas y Fincas is entitled to withdraw from the contract without complying with any period of time:
9.1. if the tenant or a person accompanying him deliberately causes damage to the property
9.2. if the tenant or a person accompanying him does not adhere to the rules of the house or bothers or endangers other persons inappropriately
9.3. if the tenant does not pay the remaining amount of the rental on day of arrival or does not leave the deposit as agreed upon.
10. Additional services
All other services offered by CYF such as arranging for flights for example, is solely intermediation of third-party services between the client and the corresponding third party. Any claims for damages by the client are to be made with the corresponding service provider.
